Matter removed from current law appears [in brackets and struckthrough.] Matter which is either (a) all new or (b) repealed and reenacted appears in regular type. 10-2620 05/09 STATE OF NEW HAMPSHIRE In the Year of Our Lord Two Thousand Ten AN ACT relative to the deposit of weekly rental payments by a tenant during an eviction proceeding. Be it Enacted by the Senate and House of Representatives in General Court convened: 1 Actions Against Tenants; Payment of Rent Pending Eviction Proceeding. Amend RSA 540:13, II(a) and (b) to read as follows: (a) If the tenant wishes to contest the eviction, he or she must file an appearance in the district court no later than the return day appearing on the writ and shall pay to the court, on a weekly basis with the first payment due upon the filing of the appearance, all rent, as it becomes due between the date of filing the appearance and the date of the final order. (b) The tenant shall not be evicted unless the court so orders; however, such an order may be granted if the tenant does not file an appearance or does not pay rent as provided under subparagraph (a). 2 Repeal. RSA 540:2, VI, relative to permitting payment of utilities in lieu of rent in certain cases, is repealed. 3 Effective Date. This act shall take effect January 1, 2011.

Kevin WessonManchesterThis bill is extremely reasonable. Tenants that unjustly file for an appearance as a stalling tactic continue to pay rent to the court. If the tenant has a legitimate case the tenant will be refunded, if not the landlord can recoup some of their losses.

Tenants who currently abuse the system and rip off the landlord by not paying rent during the eviction process will no longer be able to do so. This will help keep rents from going up as landlords won't need to charge as much to cover for thousands of rent dollars lost to non-paying tenants.
